Trump has shown you only need to act faster than the judicial system. Day 1 the new Dem president needs to sweep up the entire administration to Guantanamo. Unfortunately, for them, the rights they had no longer apply. Let the Supreme Court find a way to enforce otherwise.

The problem is that court orders like this are enforced by the US Marshals, which is an agency of the Department of Justice, which is part of the executive branch and is being ran by Trump's sycophants. Anyone in the DOJ who would've had enough of a spine to enforce this has either been fired or resigned.

The inmates are running the asylum.

If I was prosecuting, I would absolutely make the argument that 1) there is no such thing as a self-pardon and 2) you can not pardon anyone who committed crimes at your order, since that is essentially a self-pardon.

During the senate hearing with Jack Smith, one of the republicans was grilling him on presidential immunity while a president is in office, asking Smith if he thought charges would be a distraction for a sitting president and whether the Supreme Court is the final say.

Jack Smith’s answer was that his personal opinion was that nobody should be above the law no matter what their job is, but the Supreme Court is the final say and ruled the way they ruled.

Republicans apparently can’t see that advocating for a criminal to remain in office and be immune from charges just because criminal charges would be a distraction is a ridiculous position to take and looks terrible to anyone that isn’t a MAGA, corruption and crime supporting moron.

The Republicans think about it the way they do because of how they would use it against Democrats. Basically, exactly what they did with the Special Prosecutors office - run worthless investigations until they find out the President lied under oath about a blowjob, then impeach with that.

So, in their minds, if they don't protect Trump from real consequences of real crimes, the Democrats would launch pointless, distracting investigations to attack the President, because that is all the Republicans have ever done.

Immune from criminal and civil prosecution IF the action is within his official duties. How is barring the press an official duty? Also, as others note, the ruling applies only to him. Extending it to other officials is untested in court.

Here's the fun thing, Trump loves to play the "I'll do whatever I want until someone forces me to stop" game.

Courts can play that game too. They can issue a warrant for his arrest and have Trump perp-walked out of the White House with an attitude of, "I'm a judge and I'll issue whatever warrants I want until the case is decided and overturned by the Supreme Court. Then I'll just find a new legal excuse and issue another warrant."

And the Supreme Court can't intervene until after the issue is decided, and if the courts refuse bail... well, Trump could spend the mid-terms behind bars.

Judges need to push the issue and find out whether the USA is in fact a dictatorship or whether the courts still have power like they're supposed to as a separate and equal part of government.

There have been so many instances now where a judge orders something stopped or halted, and this administration just doesn’t bother complying.

Why aren't Americans protesting en masse on the streets of Washington on the regular? If Trump style shit was going on in any European country there would be constant mass protests.

Edit: Apparently USA is too large for any protest to take place. Lame excuse IMO, millions live within easy travel distance, there could easily be tens of thousands on the streets every weekend.

They're just unfortunately scattered all over the country and not really unified.

But the darkest, most painful truth is that a very, very large number of Americans either aren't aware of anything that goes on (usually by apathy, misinformation, or willful ignorance), or actively support it.

Go look at the conservative sub. Don't brigade; just observe. Note that they live on an entirely different fucking planet than the rest of us.

Now consider at least 70 million Americans think like that and live in that world.

I don't protest locally because I live in a state that actually defends my rights against the federal government. Non Americans forget about individual state government. All they think about is federal because that's all the media covers.

This isn't France. We tried that shit here in Minneapolis and they just killed people and hurt us. We are still being punished in Minnesota for daring to speak out.

Washington is like a 20 hour drive, Minneapolis is less than an hour. I was fine driving an hour, I was fine with protesting in my city, but i have a job and can't leave for a week to go to Washington. Be serious.

PS. We are also just so differently configured right now. I agree with you, we should be coming together more by now, but look at the fires in France, the protests there. And look at the militarized police here plus the federal officers at Trump’s command. Here, the police, alone, would open fire on demonstrators who go that far, and i mean, mowing down dozens if not more. 

All the more reason to protest, yes, but we are in a process that isn’t the same. We know we need more rights and i think we are going to take back power and get more rights. It’s slow to waken especially when workers are so cleverly tied down. 

I think even more than all of that there is just a ton of complacency and ignorance from never having had a real political scare before.

The current administration has made it clear that they will kill people that get in their way. The Heritage Foundation and Project 2025 said it out loud. 'This process will be bloodless as long as the Left allows it.'

We are not in the realm of politics any more. This administration is executing a coup that they announced that they intended to do. People thought they were voting for a president, without realizing all of the power that the Executive Branch actually wields.

Protesting without bloodshed is no longer going to be effective. People will have to die to eject the current administration.

Trump's tiff with the media is political theater. Being at odds with the media is his bread and butter for his base and low information voters. Sure, First Amendment rights of the press are in a pressure cooker with this stunt - but Americans and immigrants are dying in the street frequently to a paramilitary force unleashed by the administration. The admin is toying with and workshopping ideas on how to subvert state elections; including deploying the military to places Trump does not like. A lot more than First Amendment rights are at stake. We are and have been in a crisis but I find this media ban nothing but performative at this point (by both Trump and the media) and the least of our concerns.

The right fix for failure to uphold the constitution by an officer of the government is spelled out in the constitution:

In this case the judge's order was only for the White House media area. Trump has now kicked them off Air Force One. This will need a separate order. That said, Air Force One and the Oval Office have been considered more private areas than the media area, so this may be allowed.

Also, the order was only on "due process" grounds, not 1st amendment (it's typical for judges to give as narrow and simple a ruling as possible). So Trump could also just create any formal process and kick them out of the media area again based on that, and we'll need another order for that.

TL/DR Trump hasn't defied the order.
