Yeah; massive 4th Amendment violation. There really needs to be some sort of significant punishment for a government representative knowingly and voluntarily violating civil rights. Like 30 years in prison. The government isn't a discontiguous monarchy and we're not its subjects.
Don't you know it's only a 4th amendment violation if the government operates the cameras themselves? It's perfectly fine for them to purchase the exact same information from private companies.
That’s the argument, yes. But philosophically (as in Constitutional Philosophy) the violation occurred on the act of inferring association regardless of method of acquisition
Because HIPAA scares the crap out of people in the medical field. Your access is logged and if you don't have a legitimate reason for looking at someone's medical record? Bam, $10k fine. Per instance. And it goes back five years.
That would be $19 MILLION for just that one officer.
But then all those cops would have to give up one of the main perks of the job: running unofficial background checks for relatives/friends.
You've been mislead by the meme. You don't search individual cameras in individual towns. You enter a plate into the search field and it searches a database. You don't say you searched 19 trillion web pages on 2 billion computers when you google something.
.... Depends on how the law would be written, wouldn't it? The law could be written to define a single instance in any way it wants to be. Could be every time you hit enter on a search variable. Could be the number of cameras attached to the database.
well the main thing is US cops don't get punishments. if you sue cops for breaking the law and win, that's paid by taxpayers, there's no punishment to cop pension fund or anything like that.
so if you increase the fines for this sort of thing it's just irrelevant.
